1. Overview

These Terms & Conditions ("Terms") govern your use of our website and the purchase of products from Dawnbird Inc. By using the site or placing an order, you agree to these Terms.

2. What We Offer

We sell roasted coffee beans, ground coffee, tea, matcha and branded merchandise. The site allows you to browse products, place orders, subscribe to recurring deliveries, and access educational content. All prices are listed in Canadian dollars (CAD) and may change without prior notice, except for subscription pricing which will be notified before renewal https://dawnbird.coffee/policies/terms-of-service

3. Key Terms

Business days: Monday to Friday, excluding Ontario public holidays.
Defective item: a product that is damaged or not as described when you receive it.

4. Ordering and Payment

To place an order you must be of legal age (18 years or older).

We accept Visa, MasterCard, American Express, PayPal, Apple Pay, Google Pay, and Shop Pay — including Shop Pay Installments, where the price is split into scheduled payments. Payment is processed securely through Shopify and our payment gateway. Your card is charged on order confirmation, or according to the instalment schedule if you choose Shop Pay Installments.

Prices do not include shipping. Taxes are added at checkout on goods that are subject to tax.

5. Shipping and Delivery

We roast to order and dispatch within 2 business days. Standard shipping within Canada is CA$10.00 and is free on orders of CA$60 or more. Express shipping is calculated at checkout.

Delivery estimates run from dispatch: 1–3 business days in the Greater Toronto Area, and up to 7 business days elsewhere in Canada. Deliveries to rural and remote areas may take longer.

6. Returns and Refunds

Coffee, tea and other edible products are final sale and non-refundable. Defective or incorrect items, and returns of equipment and merchandise, are covered by our Refund Policy. Gift cards are non-refundable.

7. Limitation of Liability

To the fullest extent permitted by law, Dawnbird INC is not liable for indirect, incidental or consequential damages arising from the use of our site or products. Liability is limited to the purchase price of the product in question. Nothing in these Terms limits your statutory rights under Canadian consumer protection laws.

8. Intellectual Property

All content on our site (text, graphics, logos, images, videos and software) is the property of Dawnbird INC or its licensors. You may not reproduce or distribute content without prior written consent.

User‑generated content (e.g., reviews) remains your property, but you grant us a non‑exclusive, royalty‑free license to display it on the website. We reserve the right to remove any content that is unlawful, defamatory or infringing.

9. Order Acceptance

We reserve the right to refuse or cancel orders (for example, suspected fraud or incorrect pricing).

10. Changes to the Site and Terms

We may update these Terms. Material changes will be posted on this page. Continued use of the site means you accept the updated Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes will be resolved in the courts of Ontario.
