1. Overview 

These Terms & Conditions (“Terms”) govern your use of our website and the purchase of products from Dawnbird INC. By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site. 

2. What We Offer 

We sell roasted coffee beans, ground coffee, tea, matcha and branded merchandise. The site allows you to browse products, place orders, subscribe to recurring deliveries, and access educational content. All prices are listed in Canadian dollars (CAD) and may change without prior notice, except for subscription pricing which will be notified before renewal https://dawnbird.coffee/policies/terms-of-service 

3. Key Terms 
  • Business Days: Monday to Friday excluding public holidays in Ontario.
  • Defective Item: A product damaged or not as described upon receipt.
  • Subscriptions: Recurring delivery plans for coffee products; details are provided in the Subscription Policy below. 
4. Ordering and Payment 

Orders can be placed through our website. To submit an order, you must be of legal age (18 years or older). We accept Visa, MasterCard, American Express, PayPal, Apple Pay and Google Pay. Payment is processed securely through Shopify and our payment gateway; your card will be charged upon order confirmation. Prices do not include taxes or shipping fees; applicable GST/HST will be added during checkout. 

5. Shipping and Delivery 

Orders are processed within 1–2 business days. We offer free standard shipping on orders of CA$100 or more to Canadian addresses; Orders under CA$100 are subject to a shipping fee calculated at checkout based on your delivery address and selected carrier. Delivery times vary by region and are estimated at 1–3 business days within Ontario and 5–7 business days nationally. See the Shipping Policy for details. 

6. Returns and Refunds 

Coffee and edible products are final sale and nonrefundable. Unused equipment or merchandise in original condition may be returned within 30days of delivery, subject to the Return Policy below. Gift cards are nonrefundable. 

7. Limitation of Liability 

To the fullest extent permitted by law, Dawnbird INC is not liable for indirect, incidental or consequential damages arising from the use of our site or products. Liability is limited to the purchase price of the product in question. Nothing in these Terms limits your statutory rights under Canadian consumer protection laws. 

8. Intellectual Property 

All content on our site (text, graphics, logos, images, videos and software) is the property of Dawnbird INC or its licensors. You may not reproduce or distribute content without prior written consent. 
Usergenerated content (e.g., reviews) remains your property, but you grant us a nonexclusive, royaltyfree license to display it on the website. We reserve the right to remove any content that is unlawful, defamatory or infringing. 

9. Changes to the Site and Terms 

We may modify or discontinue the website or these Terms at any time. Material changes will be posted on this page. Your continued use after changes indicates acceptance. We reserve the right to refuse or cancel orders (e.g., suspected fraud, incorrect pricing). If your card has been charged for a cancelled order, we will issue a full refund. 

10. Governing Law and Dispute Resolution 

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes will be resolved in the courts of Ontario, unless otherwise required by consumer protection statutes.
